These Terms of Service ("Terms") form a binding agreement between you ("you" or "Customer") and Zenvixnet ("we," "us," or "our") and govern your use of the zenvix.com website (the "Site"), our customer-support channels, and any service we sell or facilitate on behalf of an authorized carrier ("Services"). By accessing the Site, calling our specialists, or placing an order, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the Site or the Services.
1. Eligibility
You must be at least 18 years of age, a U.S. resident, and legally able to enter into a binding contract. By using the Site, you represent and warrant that you meet these requirements and that all information you provide to us is accurate, current, and complete.
2. Authorized retailer relationship
Zenvixnet is an independent, authorized retailer of internet, television, streaming, and bundled communications services. We do not own the network and we do not deliver the Service ourselves. Service is provided by the underlying carrier and is governed by that carrier's terms of service, acceptable use policy, privacy policy, and any applicable tariff. To the extent of any conflict between these Terms and the carrier's terms regarding the actual delivery of Service, the carrier's terms control.
3. Service availability and changes
Service availability, plan terms, advertised speeds, channel lineups, equipment, and pricing vary by location and may change at the carrier's discretion. Inclusion of any plan on the Site does not guarantee that the plan can be installed or activated at your address. Final terms are confirmed at the point of order.
4. Orders and account responsibilities
- You are responsible for providing accurate service-address, contact, and payment information, and for keeping that information up to date.
- You authorize Zenvixnet and the carrier to perform identity verification and, where applicable, a soft or hard credit inquiry.
- You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account or any other suspected breach of security.
5. Pricing, billing, and payment
- Plans are typically billed monthly by the carrier. Promotional pricing applies for a limited period; standard rates apply thereafter.
- Taxes, surcharges, regulatory recovery fees, and equipment charges may be added to your bill and are not always reflected in advertised pricing.
- You authorize the carrier (and where applicable, Zenvixnet) to charge the payment method on file on a recurring basis until the Service is canceled.
- Late or failed payments may result in late fees, service suspension, or termination per the carrier's policies.
- Refunds, credits, and cancellations are governed by our Refund Policy and the carrier's policies.
6. Equipment
Equipment such as modems, routers, gateways, and set-top boxes may be leased from the carrier. Leased equipment remains the property of the carrier and must be returned in good condition within the timeframe stated upon cancellation. Failure to return leased equipment may result in non-return fees billed by the carrier.
7. Acceptable use
You agree not to use the Site or the Services to:
- Violate any law, regulation, or third-party right.
- Transmit content that is unlawful, harassing, defamatory, infringing, obscene, or otherwise objectionable.
- Distribute viruses, worms, malware, or any other harmful code; or attempt to gain unauthorized access to the Site, accounts, or networks.
- Resell or redistribute the Service to third parties unless expressly authorized in writing by the carrier.
- Engage in activity that materially degrades the network, including denial-of-service attacks, spam, or excessive commercial use of a residential plan.
We reserve the right to suspend or terminate access to the Site, and the carrier reserves the right to suspend or terminate Service, for any violation.
8. Communications consent
By providing your phone number or email address, you consent to receive transactional, service-related, and (where you have opted in) marketing communications from Zenvixnet and our service partners. Standard message and data rates may apply. You may opt out of marketing communications at any time, as described in our Privacy Policy.
9. Intellectual property
The Site, including its design, text, graphics, logos, software, and underlying code, is the property of Zenvixnet or its licensors and is protected by intellectual-property laws. You may use the Site for personal, non-commercial purposes only. All carrier names, logos, and trademarks remain the property of their respective owners.
10. Third-party services and links
The Site may contain links to or integrations with third-party websites, advertising networks (including Google Ads and Meta Ads), and content providers. We are not responsible for the content, terms, or practices of any third party. Your dealings with any third party are solely between you and that third party.
11. Disclaimers
The Site and any informational content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. 12. Limitation of liability
To the maximum extent permitted by law, Zenvixnet and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Site or Services. Our aggregate liability for any claim shall not exceed the total amount you paid to Zenvixnet (excluding amounts paid to the carrier for Service) in the six (6) months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Zenvixnet and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site or Services, or your violation of any law or third-party right.
14. Dispute resolution and governing law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Except where prohibited by law, any dispute arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Harrison County, Ohio, and you consent to personal jurisdiction in those courts. Where required by law, you may pursue claims through small-claims court or your state's consumer-protection agency.
15. Termination
We may suspend or terminate your access to the Site at any time, with or without cause, and without prior notice. Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.
16. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be communicated through a prominent notice on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
17. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, Refund Policy, Disclaimer, and Advertising Disclosure, constitute the entire agreement between you and Zenvixnet regarding your use of the Site.
